Are you a Landlord affected by the Residential Tenancies Act?

With changes from the Residential Tenancies Act to coming into force in February 2014, landlords will be required to have abandoned property valued to determine if that property will be removed for storage, sale or disposal. Landlords will be able to dispose of or destroy abandoned property if a fair estimate of the property's value is less than the cost of removal, storage, and sale of the goods.  Division 7 of the Amendment Bill dictates that unauthorised handling of abandoned property will result in a fine of up to $2500 dollars.

If the the property's value is above the estimated cost of removal and storage, the previous owners can reclaim the property from you, the landlord within 28 days of abandonment by paying you for the costs incurred whilst removing the goods from site. After 28 days, the Act allows you to sell or lawfully dispose of the furniture or other non-perishable items. 

Egans can value tenants' abandoned property and provide removal, storage and resale services should the value exceed the costs associated with these services. If the costs are deemed to be higher than the value of the property, Egans can lawfully dispose of the items on your behalf after the two day period required by law.
